Test Heads Educational Coaching, LLC Test Heads Long LSAT Prep Course and Tutoring Enrollment Agreement
This document constitutes a binding Enrollment Agreement between Test Heads Educational Coaching, LLC (“Test Heads”) and the undersigned student (“Student”) pursuant to the terms set forth below (the “Enrollment Agreement”):
A. Test Heads shall provide to Student:
(1) Access to all hours of either:
a) preparatory sessions of the Test Heads Long LSAT Prep Course ("LSAT Course") (3 proctored LSAT tests AND 38 hours of instruction which includes + 2 hours of individual tutoring + 1 hour of phone/Skype tutoring, + review of 2 LSAT essays or 1 personal statement + 35 hours of small group instruction);
b) OR enrolled-in tutoring (Tutoring);
(2) And access to all other course materials that Test Heads, in its discretion, shall determine to include in its course curriculum (collectively, the “Test Heads Materials”) ("enrolled-in" Tutoring occurs when the Student has agreed to the unaltered enrollment agreement and the payed-in-full fee for tutoring);
(3) Notice of any schedule changes or alterations regarding the course for which Student has enrolled;
B. Student agrees:
(1) Student will pay the full tuition an indicated in Paragraph E.;
(2) The Test Heads Materials are the sole and exclusive property of Test Heads, and Student will use the Test Heads Materials for the sole purpose of preparing for the LSAT;
(3) Student shall not copy or cause to be reproduced in any way, form, electronic or otherwise, any of the Test Heads Materials;
(4) Student will keep the Test Heads Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Test Heads Materials or their contents to any person or entity;
(5) Student will not disrupt, disturb, or otherwise unduly interfere with the conduct of any Test Heads meeting, as determined by Test Heads.
(6) Any Tutoring will be done in minimum 1-hour increments
(7) Any Tutoring-hour balance will expire twelve (12) months after enrollment. Any Tutoring-hour credit which is more than twelve (12) months old shall be forfeited.
C. Student warrants that Student is not an agent of, employee of, or otherwise an assistant for any other test preparation company and is taking the LSAT Course or Tutoring solely for the purpose of increasing Student’s LSAT score.
D. In the event that Student breaches any of Student’s promises and warranties as set forth in Paragraphs B and C herein, Student agrees that, in addition to and without limitation of any other right or remedy to which Test Heads is entitled, Test Heads may terminate Student’s further participation in the LSAT Course or Tutoring and may revoke Student’s right to use Test Heads Materials.
E. Tuition Payment Policy:
(1) The total cost of the LSAT Course is $750. To reserve a space in the LSAT Course, Student must pay in full at least three (3) business days before the first day of class, unless a written agreement is given by Test Heads. Reservations for the course will be made on a first-paid, first-served basis.
(2) An early-bird or other discount is only available if the student fulfills all enrollment obligations.
(3) Tutoring fees are between $40-$100 per hour ($60 for phone/Skype Tutoring), depending on the type of instruction (arrangements to be made via communication with Test Heads and confirmed in writing); a 5% discount is provided for an advanced purchase of 5 or more hours of tutoting and a 10% discount is provided for an advanced purchase of 10 or more hours of tutoring. Full payment is required in advance of instruction.
F. Tuition Refund Policy:
Student is entitled to a refund of Student’s tuition in the event that Student elects to withdraw from the Test LSAT Course or Tutoring, subject to the following conditions:
(1) Test Heads must receive notification in writing of Student’s intention to withdraw from the Test Heads LSAT Course prior to the fifth to last business day before the first day of the Course or Tutoring. If notification is received by Test Heads prior to the fifth to last business day before the first day of class, then Students' tuition payment will be refunded minus a fifty dollar ($50) non-refundable administrative fee;
(2) Student is not entitled to a refund after the fifth to last business day before the first day of class or Tutoring and is obligated to pay the full tuition for the Course
(3) Test Heads shall pay any refund due to any Student (pursuant and subject to the Paragraphs F.(1) through F.(3) herein), within thirty (30) business days of Student's withdrawal;
(4) Student is not entitled to any refund of Student’s tuition at any time, if Student is in violation of any terms of the Enrollment Agreement.
G. Transfer Policy:
Student is entitled to transfer to a later LSAT Course, subject to the following conditions:
(1) Test Heads must receive notification in writing of Student's intention to transfer to a later LSAT Course prior to the fifth to last business day before the first day of the class;
(2) If Student transfers to a later LSAT Course at any point, for contractual purposes the original Course start date remains the date of the first day of the course they originally enrolled in, not the class they transfer to. Thus, the application of paragraphs (1) through (3) of the Tuition Refund Policy will apply to the date of the first day of the original class;
(3) If notice is received by Test Heads of Student's intention to transfer from the LSAT Course on or after the fifth to last business day before the first day of the class but prior to the first day of the class, there will be a $75 administrative fee added to a student's account for that transfer, and for every subsequent transfer. In order to transfer, Student's entire tuition balance must be paid in full;
(4) No transfer can be enacted after the start of class, regardless of whether Student provides notice. However, a Student in the LSAT Course can take a future full-length class for the reduced repeater fee of $399.
(5) Except for the modification noted in paragraph (2) above, all other provisions of the Tuition Refund Policy apply to a transferring Student.
H. Missed Class Policy: No partial refund will be given for a missed session or sessions in the LSAT Course. A missed Tutoring session is defined as a session in which no notice or less than 24-hours of notice is given to Test Heads and to the instructor individually. Excessive rescheduling by Student may be considered disruptive (see B(5)). Student lateness will not result in a partial refund.
I. Returning Student Policy:
Subject to space availability, Student is entitled to re-enroll in the LSAT Course if Student is, for any reason, not completely satisfied with Student’s test performance. The re-enrollment fee is $399 for the LSAT Course. Student’s right to re-enroll is valid for a period of one (1) year from the date of Student’s original enrollment in the LSAT Course. Thereafter, no reduced fee enrollment is available.
J. Any check written by Student and returned unpaid for any reason shall be subject to a seventy dollar ($70) service fee. Any disputed charge filed with and then rated valid by the credit card company used by Student is subject to a seventy dollar ($70) service fee.
K. Any disputes, claims, or actions arising out of this Enrollment Agreement shall be governed by the laws of the District of Columbia. Student agrees to submit to personal jurisdiction in the District of Columbia to resolve any such dispute. In the event of litigation relating to the subject matter of this Agreement, the non-prevailing party shall reimburse the prevailing party for all reasonable attorney fees and costs resulting therefrom.
L. Student acknowledges that:
(1) Student has read, understands, and agrees to the terms of this Enrollment Agreement;
(2) Test Heads has made no statements, representations, promises or guarantee as to Student’s performance on the LSAT, including Student’s score or percentile.
(3) Test Heads classes are subject to change or cancellation.
(4) Student has made no alteration to the Agreement as posted on www.testheads.vpweb.com (on the date agreed to by the Student).

Test Heads Educational Coaching, LLC GMAT or GRE Crash Course/Tutoring Enrollment Agreement
This document constitutes a binding Enrollment Agreement between Test Heads Educational Coaching, LLC (“Test Heads”) and the undersigned student (“Student”) pursuant to the terms set forth below (the “Enrollment Agreement”):
A. Test Heads shall provide to Student:
(1) Access to all hours of preparatory sessions of either
a) the GMAT or GRE Crash Course (15 and 12 hours of instruction, respectively) OR the GMAT or GRE Course (30 and 24 hours of instruction, respectively) ("Course") OR
b) enrolled-in tutoring (Tutoring)
AND all other course materials that Test Heads, in its discretion, shall determine to include in its course curriculum (collectively, the “Test Heads Materials”) ("enrolled-in" tutoring occurs when the Student has agreed to the unaltered enrollment agreement and the payed-in-full fee for tutoring); AND
(2) Notice of any schedule changes or alterations regarding the course for which Student has enrolled; AND
(3) If enrolled in a Couse, a 20% discount on additional individual tutoring paid for by August 30, 2009.
B. Student agrees:
(1) Student will pay the full tuition an indicated in Paragraph E.;
(2) The Test Heads Materials are the sole and exclusive property of Test Heads, and Student will use the Test Heads Materials for the sole purpose of preparing for the GMAT or GRE (if writing Tutoring, then for improved writing skills);
(3) Student shall not copy or cause to be reproduced in any way, form, electronic or otherwise, any of the Test Heads Materials;
(4) Student will keep the Test Heads Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Test Heads Materials or their contents to any person or entity;
(5) Student will not disrupt, disturb, or otherwise unduly interfere with the conduct of any Test Heads meeting, as determined by Test Heads.
(6) Any Tutoring will be done in minimum 1-hour increments
(7) Any Tutoring-hour balance will expire twelve (12) months after enrollment. Any Tutoring-hour credit which is more than twelve (12) months old shall be forfeited.
(8) In the event that the Student wishes to enroll in more Tutoring within twelve (12) months of this Agreement, the terms of this Agreement shall apply unless agreed to with Test Heads in writing.
C. Student warrants that Student is not an agent or employee of any other test preparation company and is taking the Course or Tutoring solely for the purpose of increasing Student’s GMAT or GRE score (if writing Tutoring, then for improved writing skills).
D. In the event that Student breaches any of Student’s promises and warranties as set forth in Paragraphs B and C herein, Student agrees that, in addition to and without limitation of any other right or remedy to which Test Heads is entitled, Test Heads may terminate Student’s further participation in the Course or Tutoring and may revoke Student’s right to use the Test Heads Materials.
E. Tuition Payment Policy:
(1) The total cost of the GMAT 15-Hour Crash Course is $369 and of the GRE 12-Hour Crash Course is $320. The total cost of the GMAT 30-Hour Course is $649 and for the GRE 30-Hour course is $599. To reserve a space in the Course, Student must pay in full at least four (4) business days before the first day of class, unless a written agreement is given by Test Heads. Reservations for the course will be made on a first-paid, first-served basis.
(2) If Student completes enrollment two weeks before the start of the Course, then Student is entitled to the early-bird discount of 5%.
(3) Tutoring fees are between $40-$100 per hour, depending on the type of instruction (arrangements to be made via communication with Test Heads and confirmed in writing, email is sufficient); a 5% discount is provided for an advanced purchase of 5 or more hours of tutoting, and a 10% discount is provided for an advanced purchase of 10 or more hours of tutoring. Phone/digital tutoring is a flat rate of $60/hr.
F. Tuition Refund Policy:
Student is entitled to a refund of Student’s tuition in the event that Student elects to withdraw from the Course or Tutoring, subject to the following conditions:
(1) Test Heads must receive notification in writing of Student’s intention to withdraw from the Course prior to the fifth to last business day before the first day of class or Tutoring. If notification is received by Test Heads prior to the fifth to last business day before the first day of class or Tutoring, then Students' tuition payment will be refunded minus a fifty dollar ($50) non-refundable administrative fee;
(2) Student is not entitled to a refund after the fifth to last business day before the first day of class and is obligated to pay the full tuition for the Course or Tutoring
(3) Test Heads shall pay any refund due to any Student (pursuant and subject to the Paragraphs F.(1) through F.(3) herein), within thirty (30) business days of Student's withdrawal;
(4) Student is not entitled to any refund of Student’s tuition at any time, if Student is in violation of any terms of the Enrollment Agreement.
(5) Any unpaid balance will accrue interest at the rate of 1% per month, accrued monthly.
G. Transfer Policy:
A Student enrolled in a Courtse is entitled to transfer to a later Course, subject to the following conditions:
(1) Test Heads must receive notification in writing of Student's intention to transfer to a later the Course prior to the fifth to last business day before the first day of the class;
(2) If Student transfers to a later Course at any point, for contractual purposes the original Course start date remains the date of the first day of the Course they originally enrolled in, not the Course they transfer to. Thus, the application of paragraphs (1) through (3) of the Tuition Refund Policy will apply to the date of the first day of the original class;
(3) If notice is received by Test Heads of Student's intention to transfer from the Course on or after the fifth to last business day before the first day of the Course but prior to the first day of the class, there will be a $75 administrative fee added to a student's account for that transfer, and for every subsequent transfer. In order to transfer, Student's entire tuition balance must be paid in full;
(4) No transfer can be enacted after the start of the Course, regardless of whether Student provides notice. However, a Student in the Course can take a future Crash Course for the reduced repeater fee (discount of 50% of the price at the time of the repetition of the course) .
(5) Except for the modification noted in paragraph (2) above, all other provisions of the Tuition Refund Policy apply to a transferring Student.
H. Missed Class Policy: No partial refund will be given for a missed class or classes.
